Terms of service

This is the agreement between you and Conaer LLC for using the Conaer Aviation products. We have kept it in plain English. It is still a contract, so please read it.
The short version. Conaer is advisory software. It is not FAA approved, it is not for navigation, and it is not a dispatch release. You stay responsible for your own flight and your own compliance. Use it honestly, do not attack it, and we will keep building it.
Accepting these terms
By creating an account or using any part of Conaer Aviation, you agree to these terms. If you do not agree, do not use it. If you are using Conaer for an employer or a certificate holder, you are telling us you have the authority to accept these terms on their behalf, and "you" then means both of you.
You need to be at least 13 years old to use Conaer, and old enough under the law where you live to enter a contract.
What the service is
Conaer Aviation is a set of web products:
- The Alternate Engine. An advisory planning tool that computes, from public FAA and NOAA data and from operations specifications an operator has uploaded, whether a destination requires an alternate airport and which candidate airports qualify. It shows the reasoning at every step.
- Conaer Ground School. Pilot study apps built from public FAA sources.
- Dispatch Prep. Study drills for the aircraft dispatcher written test and interview.
- The trainers at /fly and /sms. Practice and safety management study tools.
We change and improve these products. We may add features, remove features, or stop offering a product entirely. If we are going to shut something down that you rely on, we will tell account holders first.
Your account
- Give us an email address that is really yours and keep it current.
- Keep your password to yourself. Anything done with your account is treated as done by you.
- Tell us at once if you think somebody else is in your account. Email privacy@conaeraviation.com.
- One account per person. Do not share a login across a dispatch desk. The audit record and the fair use limits both depend on that.
- Some accounts are bound to a single operator by an administrator. A bound account can only be run against that operator ruleset, and trying to run it against another one will be refused rather than quietly substituted.
You can close your account at any time by emailing us. We can close or suspend an account that breaks these terms, that puts the service or other users at risk, or that we are required to close by law.
Acceptable use
We are asking for the obvious. Do not:
- use Conaer as a source of navigation, as a dispatch release, or as a substitute for any document or system a regulation requires
- upload material you do not have the right to upload, including any operator document you are not authorized to share
- scrape, bulk download, or run automated requests beyond your account limits, or work around those limits
- reverse engineer, decompile, or try to extract our source data sets, except where the law says we cannot stop you
- break into anything, probe for holes without telling us, or interfere with other users of the service
- resell Conaer, or wrap it inside another product, without a written agreement with us
- use it to break any law or any aviation regulation
- misrepresent Conaer as approved, certified, or endorsed by the FAA, by any authority, or by any airline
Security research is welcome. Tell us privately, give us a reasonable chance to fix it, and do not touch other people data while you look.
Fees
Conaer Aviation is free to use today. If we start charging for a product, we will publish the price and tell account holders before any charge applies, and you will be able to stop using the paid part rather than pay for it. Nothing in these terms lets us bill you without you agreeing to a price first.
No warranty
Conaer is provided as is and as available, without warranties of any kind, whether express, implied or statutory. To the fullest extent the law allows, we disclaim the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
We do not warrant that the service will be available, uninterrupted, timely, secure or error free, that the data in it is accurate, current or complete, or that any defect will be corrected. Aeronautical and weather data comes from third parties and from caches of third party data, and it can be stale, incomplete or wrong.
No advice or information you get from us, in the app or anywhere else, creates a warranty that is not written in these terms.
Limitation of liability
To the fullest extent the law allows, Conaer LLC and anyone working with us will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, flight delay, diversion, cancellation or any business interruption, arising out of or connected with your use of Conaer, even if we were told such damages were possible.
To the fullest extent the law allows, our total liability to you for all claims connected with Conaer is limited to the greater of the amount you paid us in the 12 months before the claim arose, or one hundred United States dollars.
These limits do not apply to liability that cannot be limited by law, including our own gross negligence, wilful misconduct or fraud. Some places do not allow some of these exclusions, and in those places these terms apply only as far as the law permits.
Aviation limits
This section is the one that matters most, and the full statement is on the aviation disclaimer page, which is part of these terms.
- Conaer is advisory only. It is not for navigation and it is not a dispatch release.
- Conaer is not an FAA approved source and not a certified system. It carries no FAA design approval, no technical standard order authorization and no type certificate.
- Nothing Conaer produces relieves anyone of a regulatory duty. Under 14 CFR 121.533 the certificate holder is responsible for operational control, and the pilot in command and the aircraft dispatcher are jointly responsible for preflight planning, delay and dispatch release. Under 14 CFR 121.663 the pilot in command and an authorized dispatcher sign the release only if they both believe the flight can be made with safety, and the authority to dispatch cannot be delegated. Under 14 CFR 121.687 the release carries the required contents and the latest available weather. Those duties stay exactly where the regulations put them.
- The official sources of record are the FAA and NOAA publications, the operations specifications issued to your certificate holder, and your operator manuals. Where Conaer disagrees with them, they win.
- The study products are not FAA approved courses, they do not substitute for a certificated instructor, and they grant no endorsement, credit or currency.
What you own and what we own
Yours stays yours. Files you upload, the operations specifications your operator provides, and the settings and progress you create remain yours. You give us permission to store and process them only so far as we need to in order to run the service for you. We do not use your uploads to train models and we do not sell them.
Ours stays ours. The Conaer software, the engine logic, the interface, the study content we wrote, the name Conaer and our logos belong to Conaer LLC. We give you a personal, non-exclusive, non-transferable, revocable license to use the service while these terms are in force. That license does not let you copy the product, sell access to it, or build a competing service out of it.
Government source material. Conaer is built on public material published by the FAA and by NOAA and the National Weather Service: the Code of Federal Regulations, the Aeronautical Information Manual, the Airman Certification Standards, FAA handbooks, charts, airport and procedure data, METAR, TAF and other weather products. Under 17 U.S.C. 105, copyright is not available for a work of the United States Government, so that material is not copyrighted by us and we claim no ownership of it. What we do claim is our own selection, arrangement, code, explanations and interface.
We are not affiliated with, endorsed by, or approved by the FAA, NOAA, the National Weather Service, any government agency, or any airline. Nothing we publish should be read as implying that we are, and we do not use any agency name or seal in a way that suggests endorsement.
If you think something on Conaer infringes your copyright, email privacy@conaeraviation.com with enough detail to find it and we will look into it promptly.
Your promise to cover us
You agree to defend, indemnify and hold harmless Conaer LLC and the people who work with us from any claim, loss, liability, damage or cost, including reasonable legal fees, arising out of your use of the service, your breach of these terms, material you uploaded, or your violation of any law or the rights of anyone else. We will tell you about any such claim, let you control the defense with counsel we can reasonably approve, and cooperate with you.
Termination
You can stop using Conaer and close your account whenever you like. We can suspend or end your access if you break these terms, if your use puts the service or other people at risk, or if we are required to by law. We will give you notice when we reasonably can.
When an account ends, your right to use the service ends with it. The sections on no warranty, limitation of liability, aviation limits, intellectual property, indemnity and governing law survive. So does the alternates audit record, which carries no account identifier and is kept as a business record.
Governing law and venue
These terms are governed by the laws of the State of Texas, United States, without regard to its conflict of laws rules. Any dispute that is not resolved between us will be brought exclusively in the state or federal courts located in Dallas County, Texas, and you and we each consent to the personal jurisdiction of those courts. Nothing here stops either of us from seeking an injunction where one is genuinely needed.
If you are a consumer in a place whose law gives you the right to bring a claim locally, or gives you rights that cannot be waived, this section does not take those away.
The rest of the legal wiring
- These terms, the privacy policy and the aviation disclaimer are the whole agreement between us about Conaer.
- If a court finds part of these terms unenforceable, the rest stays in force and that part is trimmed to what is enforceable.
- If we do not enforce something straight away, we have not given it up.
- You cannot transfer these terms to anyone else without our written agreement. We can transfer them to a successor of the business.
- We are not liable for a failure to perform caused by something genuinely outside our control, including a failure of a government data source.
- Nothing here creates a partnership, a joint venture, an agency, or an employment relationship between us.
Changes to these terms
We update these terms from time to time. When we do, we change the date at the top of this page, and for a change that materially affects your rights we email account holders before it takes effect. If you keep using Conaer after a change takes effect, you are accepting it. If you do not want to, close your account.
